The respect of your privacy is of the utmost importance to Lean Agility Inc., who is responsible for this website.

This Privacy Policy describes:

  • how your personal information is collected and processed. "Personal information" means any information that could identify you, such as your name,  your email address, your location, and your IP address, note that “Personal Information” does not include business contact information;
  • your rights regarding your personal information;
  • who is responsible for the processing of the collected information;
  • to whom the information may be transmitted;
  • how we obtain your consent for marketing communications;
  • our policy regarding cookies and analytics tools.

1. COLLECTION OF PERSONAL INFORMATION

We may collect the following information from you:

  • Last name and first name
  • Email address
  • Phone number
  • Organization or employer
  • Job title or role
  • IP address and technical browsing data (collected automatically via cookies and analytics tools)

We collect only the information necessary for the purposes described in this Policy.

2. METHODS OF COLLECTION

Your personal information is collected through the following methods:

  • Website forms (contact, registration, and resource download forms)
  • Training and event registration
  • Direct communications with our team by email or phone
  • Automatically through cookies and analytics tools when you visit our website (see Section 4)

3. PURPOSES OF COLLECTION AND USE

We only use personal information where the applicable law permits or requires it. We may use the personal information we collect for the following legitimate business purposes:

  • To respond to your enquiries and requests
  • To register you for training, events, or programs
  • To send you communications you have consented to receive (see Section 7)
  • To manage our relationship with you as a client or prospective client
  • To improve our website and understand how visitors use it

4. COOKIES AND ANALYTICS

a) Cookies used by the Website

Our website uses cookies and similar technologies to collect information about how visitors use the site. This includes:

  • IP address
  • Operating system and browser type
  • Pages visited and search queries
  • Date and time of visit

b) Google Analytics and Google Tag Manager

Our website uses Google Tag Manager and Google Analytics, services provided by Google LLC (United States). These tools collect aggregated information about website traffic and visitor behaviour to help us understand and improve our website. This data is transferred to and processed by Google in the United States. Google operates under its own privacy policy, available at policies.google.com/privacy.

c) How to manage cookies

You may configure your web browser to refuse or delete cookies at any time. You may also opt out of Google Analytics tracking by using the Google Analytics Opt-out Browser Add-on available at tools.google.com/dlpage/gaoptout. Disabling cookies may affect certain features of the website, but you may continue to use the site.

5. SHARING OF PERSONAL INFORMATION

Lean Agility Inc. does not sell your personal information. We share personal information only in the following circumstances:

a) Service providers

We use the following third-party service providers who may process your personal information on our behalf:

HubSpot, Inc. — We use HubSpot as our customer relationship management (CRM) platform, for website forms, and for email marketing. Lean Agility Inc. has configured HubSpot to store and process personal information in Canada. HubSpot operates under its own privacy policy, available at legal.hubspot.com/privacy-policy.

Where attendees register for Lean Agility events via Eventbrite, registration data may be shared with HubSpot through an integrated connection.

QuickSilk / Cartika (Canada) — Our website is built and managed on the QuickSilk content management platform, hosted on infrastructure provided by Cartika in Canada. QuickSilk processes website server logs, including IP addresses and page visit data, in the course of managing our website. Personal information submitted through website forms is managed through HubSpot and is not processed by QuickSilk or Cartika. QuickSilk operates under its own privacy policy, available at quicksilk.com. Cartika operates under its own privacy policy, available at cartika.com/privacy-policy.

GoDaddy.com, LLC (United States) — Our domain name is registered through GoDaddy, located at 2155 E GoDaddy Way, Tempe, AZ 85284. GoDaddy operates under its own privacy policy, available at godaddy.com/legal/agreements/privacy-policy.

Google LLC (United States) — Google Analytics and Google Tag Manager are used for website analytics as described in Section 4. Analytics data is processed by Google in the United States.

Microsoft Corporation (Canada) — We use Microsoft 365, including Outlook, for internal communications and document management. Lean Agility Inc. has configured Microsoft 365 to store data in Canada. Microsoft operates under its own privacy policy, available at privacy.microsoft.com/en-ca/privacystatement.

b) Legal requirements

We may disclose personal information if required to do so by law or in response to a valid legal request from a public authority.

c) Consent

Information may be disclosed where the individual provides explicit consent.

6. TRANSFER OF PERSONAL INFORMATION OUTSIDE CANADA

Personal information collected and managed through our website and CRM platform is stored in Canada. However, our use of Google Analytics and Google Tag Manager involves the transfer of website analytics data to Google LLC in the United States, where it is subject to US law.

Our use of GoDaddy for domain name registration involves the transfer of domain registration data to GoDaddy.com, LLC in the United States, where it is subject to US law.

Although Lean Agility Inc. has configured Microsoft 365 to store data in Canada, Microsoft’s Data Protection Addendum permits Microsoft and its subprocessors to process data internationally. Accordingly, some personal information processed through Microsoft 365 may be transferred outside Canada and subject to the laws of those jurisdictions.

We require our service providers to implement appropriate safeguards to protect your personal information. If you have questions about how your personal information is protected, please contact our Privacy Officer (see Section 9).

7. MARKETING COMMUNICATIONS AND CONSENT

Lean Agility Inc. sends marketing and informational communications in compliance with Canada's Anti-Spam Legislation (CASL).

a) How we obtain consent

We send marketing communications only to individuals who have given their express consent. Consent is obtained through a checkbox on our website forms, which is never pre-selected. When you opt in, you choose which types of communications you wish to receive from the following:

  • Training and Event Announcements: upcoming training courses, workshops, and events
  • Resources and Insights: articles, blog posts, and practical tools on lean and agile practices
  • Newsletter: a regular roundup of lean and agile news and insights for public sector professionals

b) How to withdraw consent

You may withdraw your consent to receive marketing communications at any time by clicking the unsubscribe link in any marketing email we send, or by contacting our Privacy Officer at anne@leanagility.com. Withdrawal of consent takes effect promptly and we will not send further marketing communications once your request has been processed.

c) Identification

All marketing emails sent by Lean Agility Inc. clearly identify us as the sender and include our contact information and an unsubscribe mechanism, as required by CASL.

8. RETENTION OF PERSONAL INFORMATION

Lean Agility Inc. retains personal information for as long as necessary to fulfil the purposes for which it was collected, or as required by law. In general, we retain personal information for a maximum of two (2) years from the date of last contact or the end of our relationship with you, after which it is securely deleted or anonymized.

In the event that the integrity, confidentiality, or security of your personal information is compromised, the Privacy Officer will notify you and, where required by law, the relevant regulatory authority.

c) Responsibilities of Lean Agility Inc.

Lean Agility Inc. is responsible for all personal information in its possession or under its control. We will use contractual or other means to provide comparable protection where information is transferred to a third party.

10. YOUR RIGHTS

Subject to applicable law, you have the following rights regarding your personal information:

a) Right of access

You have the right to request access to the personal information we hold about you and to receive information about how it is being used. We will make information about our policies and practices related to the management of personal information readily available.

b) Right of rectification

You have the right to request that inaccurate or incomplete personal information be corrected.

c) Right of withdrawal and objection

You have the right to withdraw your consent to the processing of your personal information and to object to its use for certain purposes, including direct marketing.

d) Right of deletion

You may request the deletion of your personal information where it is no longer necessary for the purposes for which it was collected, subject to our legal obligations to retain certain records.

e) Right to data portability

Where technically feasible, you have the right to receive a copy of the personal information you have provided to us in a structured, commonly used, and machine-readable format.

f) Right to deindexation

Where applicable, you may request that we take reasonable steps to ensure that any hyperlinks pointing to personal information about you that has been disseminated are no longer indexed or accessible by a technological means.

To exercise any of the above rights, please contact our Privacy Officer at anne@leanagility.com. We will respond to your request within thirty (30) days. Where a request is complex or numerous, we may extend this period by a further thirty (30) days, in which case we will notify you and provide the reasons for our extension. 

11. SECURITY AND SAFEGUARDS

Personal information collected by Lean Agility Inc. is stored in a secure environment. All individuals with access to personal information are required to respect its confidentiality.

We use the following measures to protect your personal information:

  • SSL (Secure Sockets Layer) encryption for data transmission
  • Access controls limiting who can view personal information
  • Password-protected systems

We also ensure that any third party with whom we share personal information has adequate safeguards in place prior to sharing information with them.

12. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy may be viewed at any time at: www.leanagility.com/en/privacy-policy

We reserve the right to modify this Privacy Policy to ensure it remains compliant with applicable law and reflects our current practices. We encourage you to review it periodically.

In the event of a material change to this Privacy Policy, we will notify registered users by email to the address provided.

13. ACCEPTANCE

By using our website and submitting information through our forms, you acknowledge that you have read and understood this Privacy Policy and that you accept its terms, in particular those relating to the collection and processing of personal information and the use of cookies.

15. APPLICABLE LAW

Lean Agility Inc. is committed to complying with the following legislation:

  • Personal Information Protection and Electronic Documents Act, SC 2000, c 5 (PIPEDA)
  • Act Respecting the Protection of Personal Information in the Private Sector, CQLR c P-39.1, as amended by An Act to modernize legislative provisions as regards the protection of personal information, SQ 2021, c 25 (Quebec Law 25)
  • Canada's Anti-Spam Legislation, SC 2010, c 23 (CASL)

13. COMPLAINTS

For questions or concerns about this Privacy Policy or the handling of your personal information, please contact our Privacy Officer at anne@leanagility.com. All complaints will be investigated and, if found to be justified, appropriate measures will be taken including, if deemed necessary, amending Lean Agility Inc.’s privacy policies and practices.

If an individual is not satisfied with Lean Agility Inc.’s response to a complaint, that individual may submit a complaint to the Federal Office of the Privacy Commissioner.
